CITY OF ANOKA <br /> <br />FOR I~IRE PROTECTIO~ .M~TD <br /> <br />1984 <br /> <br /> THIS AGREEHEHT, made and entered tnto by and between the City of Anoka, a Hunicipal <br />Corporation, of the County of Anoka and State of Minnesota, party of the first part, <br />hereinafter referred to as the "City", and the City of Ramsay in the County of Anoka, <br />State of Minnesota, party of the second part. <br /> <br /> WITNESS[TH: <br /> That in consideration of the sum of Thirty two thousand, seventy four and 68/100 <br />Dollars per year, payable tn advance by second party to said City, said City agrees to <br />furnish fire protection, fire suppression, emergency rescue, extrication and those other <br />services normally and customarily performed by a fire department to the property located <br />in, or emergency incidents within the boundaries of said City of Ramsey, for the <br />compensation and on the conditions hereinafter set forth, and the said City further agrees <br />that when called to property or incidents within the boundaries of the City of Ramsey, its <br />firefighters will make a reasonable effort to respond to fires or perform other requested <br />emergency services, PROVIDED HDWEV£R: <br /> <br /> 1. That the road and weather conditions be such that the emergency response can be <br />made with reasonable safety to personnel and equipment, and the decision of the Anoka Fire <br />Chief or senior fire department officer in charge shall be final in such a matter. <br /> <br /> 2. That in the event all fire department equipment and personnel are engaged in <br />another emergency situation at the time a call comes in from said second party, the Anoka <br />Fire Department will.call for mutual aid and any other help that might be available, <br />because of the emergency or dtsasterous nature of the situation. However if all means of <br />providing service are exhausted, and in the discretion of Anoka City officials and the <br />Fire Chief or senior fire officer in charge, such equipment and members of said fire <br />department are needed in Anoka, the City shall be held free and relieved from all <br />liability to make said run or to respond to said call. <br /> <br /> 3. In the event the Anoka Fire Department has responded to an emergency in the <br />City of Ramsay and another fire department emergency response is required within the <br />City of Anoka, the Anoka Fire Department will not leave the City of Ramsey emergency <br />situation unattended. The Anoka Fire Department will either remain to perform the <br />necessary emergency service or will provide services from another municipality through <br />mutual aid agreements. <br /> <br /> 4. If for any reason the Fire Chief or senior fire officer shall decide that no <br />equipment or ftreftghters can be spared, the decision of the Fire Chief or senior fire <br />officer shall be ftnal. <br /> <br /> 5. That said City shall not be liable in any way to the second party or to any other <br />person, firm or corporation for fmilure of the Department of said City to attend a fire or <br />to extt.nguish a fire or for any damage to or loss of goods, or for any act, omission, or <br />for any other reason <br /> <br /> 6. That in addition to the above mentioned sum of Thirty two thousand, seventy four <br />and 68/100 dollars per year, said second party agrees to pay as compensation for services <br />rendered hereunder, the cost of each run by the Ftre Department to said City when called <br />by said second party or when made for the benefit of said second party or when made to a <br />place withtn the boundaries of said second party, said sum to be paid when btlled by City. <br />Said cost of run to be based on the following scheduTe: <br /> <br /> One Hundred Fifty and 00/100 ($150.00) per run for the first hour or fraction <br />thereof. <br /> Sixty and 00/100 ($60.00) for each additional one-half hour or fraction thereof. <br /> <br /> <br />
