I I I I I I I I I I I I I I I I i I FINDINGS OF FACT MR. ARNOLD KLAR 1) That the applicant has properly applied for a conditional use permit as required by City Ordinance. Z) That the applicant appeared before the Planning and Zoning Commission for a public hearing pursuant to the City Zoning Ordinance on February 7, 1984. That said public hearing was properly advertised and the minutes of that public hearing are hereby incorporated by reference. 3) That the standards for consideration are as follows: a) The property is zoned R-1 and this is not a permitted use. b) The adjoining properties are residential dwellings located on approximately one acre parcels. c) There are no known similar authorized uses in the City. d) There will be no major changes in traffic flow to the area. e) Properly operated, the wood sales (no pickup) will not affect the lifestyle of the neighboring residents in a rural setting. Further, it should not affect the enjoyment or value of properties in the vicinity. 4) That the criteria for approval/disapproval are as follows: a) That the applicant's request is to operate his business, the sale of firewood, at his residence located at 160Z0 Potassium Street NW, Ramsey, Minnesota 55303 and to keep at his residence some firewood and his delivery trucks. b) Properly stored, the sale of firewood should not be unsightly or undesirable or obnoxious in appearance and not hinder the orderly and harmonious development of the City or district where herein proposed. c) Adequate water supply and sewage disposal facilities will be provided. d) The use will conform to the regulations of R-l, residential, zoning except that a conditional use permit is required. 5) That the performance standards are as follows: a) Fire protection is provided by the City of Anoka, however, the sale of firewood should not create a fire hazard. b) Electrical disturbances are not applicable. c) Vibration will not be applicable. d) Odors will not be applicable. 6) That the City of Ramsey reserves the right to inspect the premises if it should receive complaints. 7) That the applicant has brought his request to the City Council and they directed the preparation of findings of fact in accordance with Sections 170.016D, 170.016E, and 170.016F of the Ramsey City Ordinance.
