'1 <br /> <br />I <br />I <br />I <br /> <br />RESOLUTION ~ 84~1 <br /> <br /> WHEREAS, NDH, Inc. has applied to the City for a Planned Unit <br />Development (PUD) final approval and for PUD zoning by an application dated <br />November 15, ]983 both for the following described property, to wit: <br /> <br />I <br />I <br /> <br /> I <br /> I <br />I <br />I <br />I <br />I <br />I <br /> <br />That part of the south half of the Southwest Quarter and of <br />Government Lot 3, Section 25, Township 32, Range 25, Anoka <br />Count)', Minnesota, lying easterly of the plat-of Flintwood Hills <br />and lying westerly of the center line of State Highway ~.47 <br />as now laid out and traveled. Except that part described as <br />follows: Beginning at the southwest corner of said Government <br />Lot 3; thence westerly on the southerly line of said Southwest <br />Quarter a distance of 82.5 feet; thence northerly at right angles <br />to said southerly line of said Southwest Quarter a distance of <br />291.43 feet; thence easterly parallel with said southerly line <br />of said Southwest Quarter, to the center line of said State <br />Highway ~47; thence southeasterly, along said center line of <br />said highway, to the southerly line of said Government Lot <br />3; thence westerly along said southerly line of said Government <br />Lot 3 to the point of beginning. <br /> <br />And, Outlot 1, Flintwood Hills, Anoka County, Minnesota. <br /> <br />And that part of the Northwest Quarter of the Northwest Quarter <br />of Section 36, Township 32, Range 25, Anoka County, Minnesota, <br />lying northerly of the center line of County Road ~116 as now <br />laid out and traveled and lying southerly and easterly of the <br />plat of Flintwood Hills and lying easterly of the westerly 6(>0.0 <br />feet thereof as measured parallel with the north line. <br /> <br />PIN R-25-3 2-25-33-0020/074Z094 <br />and R-25-3 2-25-34-0001/0734156 <br /> <br /> Wlq~REAS, the City's Planning and Zoning Commission held a public <br />hearing on the application on November 29, 1983; and <br /> <br /> WItE-REAS, the City Council held a public hearing on the PUD application <br />on January 10, '1984; and <br /> <br /> WIIEREAS, the applicant had not provided the necessary information <br />to either the Planning and Zoning Commission or the City Council prior to their <br />respective bearing, such as to permit the Council to consider prelim/nary <br />development plan approval of the PUD; and <br /> <br /> WHEREAS, the requirements of the City Code, Section 170.014G must <br />be met prior to the City granting preliminary development plan approval; and <br /> <br /> WHEREAS, the City Council, after it receives the data required by Section <br />170.014G of the Code must then conduct a public hearing in order to grant <br />preliminary develoT~,enl plan approval; and <br /> <br /> <br />
