James ~etlson <br /> Babcock, Lvsher, Neilson & Mannella <br />8 East Main Street <br /> oka, Minnesota 55303 <br /> <br />ie: Letter of Understanding for Drainage Easements <br />Lots 13 and 14, Bower's Mississippi Acres <br /> <br /> Dear Mr. Neilson: <br />Ilease accept this letter of understanding as a commitment by the City of Ramsey for <br />acquisition of the above referenced easements. <br />I!ollowing is a list of items the City will complete or adhere to in return for the <br />10-foot permanent and 20-foot temporary easement~ over Lots 13 and 14 of Bower's <br />iississIppi Acres: <br /> <br /> · No work will be commenced until a waiver of trespass is signed by both parties. <br /> <br />I. No tree will be removed outside of the 10 feet of easement each <br /> permanent <br /> over <br /> lot unless authorized by the lot owner. <br /> <br />Rip rap along the river bank shall be sized a~d placed to match the existing <br />rip rap. No concrete shall be used. In addition, the City shall provide <br />adequate rip rap to stabilize the permanent easements along the river bank and <br />the City will be responsible.for maintenance of the river bank in the easement <br />area. <br /> <br />The easement language in the deeds shall be revised to state that the City's <br />use will be limited to underground storm drainage purposes only and the <br />landowners will be allowed to place trees within five feet of the lot line. <br />aowever, the City will maintain the right to enter upon the entire 10 feet of <br />the permanent easement on each lot and will not be liable for any damage to <br />trees. <br /> <br />I <br />I <br />I <br /> <br />Upon execution of this letter of understanding by the landowners, the City <br />agrees to fill Lots 13 and 14 of Bower's Mississippi Acres over an area <br />approximately 150 feet by 100 feet as staked out by the landowners. In no case <br />will the fill area be within 100 feet of the bluff line of the river, The <br />amount of fill will be 6,000 cubic yards and in the event the fill area does <br />not have adequate capacity at an elevation of one foot (1') above the 100 year <br /> <br /> <br />
