I <br />II <br />II <br />II <br /> <br />! <br /> <br />(f) If City fails to approve the change of rates or <br /> charges within the 31 day period, the rate shall <br /> still become effective upon the date specified in <br /> the notice of Grantee. <br /> <br />(g) City may utilize a rate consultant to advise it on <br /> proposed rate changes and to assist it in main- <br /> taining uniform rates within the rate territory. <br /> A rate consultant may be any person who has suf- <br /> ficient background and experience, in the sole <br /> opinion of City, to properly evaluate and analyze <br /> rates and charges. <br /> <br />(h) All costs for the review of a notice for a rate or <br /> charge change shall be paid by City from the Fran- <br /> chise fee. <br /> <br />(i) Any time limit may be waived only if City and <br /> Grantee consent. <br /> <br />(j) If City fails to approve the change of rates, <br /> either City or Grantee may initiate binding arbi- <br /> tration pursuant to Minnesota Statutes except as <br /> delineated below. <br /> <br />(k) The parties shall, within 15 days of City's fail- <br /> ure to approve the rate increase, appoint one <br /> arbitrator each who is experienced and knowledge- <br /> able in the evaluation and analysis of cable rate <br /> and charge changes. Arbitrators shall each agree <br /> upon the selection of a third arbitrator, simi- <br /> larly qualified, within 15 days after appointment <br /> <br />44 <br /> <br /> <br />
