n <br /> <br />il <br />II <br />il <br />II <br />II <br />II <br /> <br />II <br />II <br />II <br />II <br />II <br />II <br />II <br /> <br />I <br /> <br />Be <br /> <br /> any way contribute; <br /> (2) Arising out of any claim for invasion of the right of <br /> <br /> privacy, for defamation of any person, firm or corpora- <br /> tion, or the violation or infringement of any copy- <br /> right, trademark, trade name, service mark or patent, <br /> or of any other right of any person, firm or corpora- <br /> tion, except claims because of City's own programming; <br /> and <br /> <br /> (3) Arising out of Grantee's failure to comply with the <br /> provisions of this Franchise, any federal, state or <br /> local law, ordinance or regulation applicable to Grant- <br /> ee or the System. <br /> <br /> (4) Any and all claims which Grantee may now or hereafter <br /> <br /> have or claim to have against City, its servants, <br /> agents, employees or officials, due to or arising out <br /> of damage to any of Grantee's property or equipment, <br /> including, without limitation, resulting or consequent- <br /> ial loss of income, injury to reputation, or any other <br /> resulting or consequential damages of any kind, caused <br /> by or resulting from acts or omissions of City or any <br /> of its servants, agents employees or officials. <br /> <br />If suit be brought or threatened against City, either inde- <br />pendently or jointly with Grantee, or with any person or <br />municipality, Grantee, upon notice given by City, shall de- <br />fend City at the cost of Grantee, and if final judgment is <br />obtained against City, either independently or jointly with <br />Grantee, or any other defendants, Grantee shall indemnify <br /> <br />56 <br /> <br /> <br />
