I <br />I <br />I <br />I <br />I <br /> <br />I <br />I <br /> <br /> I <br /> I <br /> I <br /> <br /> I <br /> I <br /> I <br /> I <br /> <br />LICENSE AGREEMENT <br /> <br /> TIIIS AGREEMENT is made and entered into this t~4 day of August, 1990, between the <br />County of Anoka, a political subdivision of the State of Minnesota, hereinafter referred to as the <br />"Licensor", and the City of Ramsey, 15153 Nowthen Boulevard N.W., Ramsey, Minnesota 55303, <br />hereinafter referred to as "Licensee". <br /> <br />In consideration of the mutual promises herein contained, the parties agree as follows: <br /> <br />GRANT OF LICENSEi DESCRIPTION OF PREMISES <br /> <br /> Licensor hereby grants to Licensee a license to occupy and use, subject to all the terms and <br />conditions hereof, property located in the Northwest Quarter of Section 16, Township 32, Range 24, <br />Anoka County, Minnesota, and more particularly depicted in Exhibit A, which is attached hereto and <br />incorporated herein by reference, <br /> <br />II. LIMITATION TO DESCRIBED PURPOSE <br /> <br /> The premises may be used by Licensee solely for the purpose of maintaining and operating <br />an eight foot wide bituminous bike and pedestrian trailway. <br /> <br />III. INDEMNIFICATION <br /> <br /> Licenseee agrees to hold harmless and defend the Licensor, its officers, agents and employees, <br />from any and'all liability and claims, including attorneys fees, concerning, related to or resulting from <br />the use of the premises and for all claims of damages to any party arising from or related to the use <br />of the above described premises under this license. <br /> <br />IV. APPROVAL OF PLANS <br /> <br /> Prior to construction, Licensee shall submit to Licensor plans for the proposed bike and <br />pedestrian trailway for approval by thc Licensor. No construction shall begin until the plans have <br />been approved in writing by the Licensor. Approval of the plans by the Licensor shall constitute <br />approval for the purposes hereof only and shall not be deemed to constitute approval or waiver by <br />the Licensee with respect to any building, zoning or other ordinances, regulations or statutes that may <br />be applicable to the construction of the bike and pedestrian trailway. <br /> <br />V. COST OF CONSTRUCTION, REPAIR AND MAIWrtENANCE <br /> <br /> The Licensor shall be solely responsible for the cost of constructing, maintaining and repairing <br />the pedestrian and bike trailway. <br /> <br /> <br />
