Board Member introduced the following resolution and moved for its adoption: RESOLUTION #04-07- A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND DECLARING TERMS OF SAME. WHEREAS, RAMDANCE LLC, hereinafter referred to as "Applicant," 'has properly applied fbr a variance from Section 9.20.25(3)(b) regarding maximum front yard setbacks in the TC-2 Sub-District of the Town Center District, on the property legally described as follows: Outlot I, Ramsey Town Center Addition, Anoka County, Minnesota ("Subject Property); and WHEREAS, the Board of Adjustment met on July 12, 2004, conducted the public hearing and adopted findings of fact relating to the request for a variance from the maximum f?ont yard setback requirements as part of the development of the Subject Property. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows Based on Resolution #04-07- adopting Findings of Fact #__, a variance to the maximum front yard setback, as established in Section 9.20.25(3)(b) of the Ramsey City Code, is approved fbr the development of a grocery store on the Subject Property. That the placement of the grocery store shall generally be in accordance with the Preliminary Site Plan prepared by URS dated July 8, 2004. The Permittee shall be responsible for all City costs incurred in processing the variance request. The motion for the adoption of the foregoing resolution was duly seconded by Board Member and upon vote being taken thereon, the following voted in favor thereofi and the ~bllowing voted against the same: and the fbllowing abstained: and the [bllowing were absent: Whereupon said resolution was declared duly adopted by the Ramsey Board of Adjustment this the 12th dayofJuly 2004. RAMDANCE, LLC hereby acknowledges receipt of this variance and has reviewed the te~Tns of the variance and has agreed to comply with the terms of the variance.
