Councilmember <br />its adoption: <br />introduced the following resolution and moved <br />RESOLUTION #16-09-165 <br />RESOLUTION AUTHORIZING ACTION TO CONDEMN DRAINAGE <br />AND UTILITY EASEMENT <br />WHEREAS, the property at 16259 Coquina Street contains a natural storm water <br />drainage area; and <br />WHEREAS, the City desires to obtain a drainage and utility easement over the <br />drainage area to protect it from any uses that may be adverse to storm water drainage; and <br />WHEREAS, the City desires to that its easement have priority over the existing <br />mortgage on the property, but releasing the mortgage over the easement area is not <br />financially feasible; and <br />WHEREAS, the City has statutory authority to acquire the easement by eminent <br />domain. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) The City Council hereby authorizes staff and the City Attorney to acquire the <br />drainage and utility easement over 16259 Coquina Street by eminent domain. <br />The motion for the adoption of the foregoing resolution was duly seconded by <br />Councilmember , and upon vote being taken thereon, the <br />following voted in favor: <br />and the following voted against: <br />and the following abstained: <br />and the following were absent: <br />Whereupon said resolution was declared duly passed and adopted by the Ramsey City <br />Council this 13th day of September, 2016. <br />Mayor <br />ATTEST: <br />City Clerk <br />
