The City Council introduced the proposed ordinance on May 25, 2004. Since that time, Staff has
been verifying references to other sections of City Code within the proposed ordinance. Also,
subsequent to introduction of the ordinance, it has come to the attention of City Staff that DNR
did not receive 30 day notice of the public hearing conducted by the Planning Commission.
Therefore, an additional public hearing was advertised to be conducted by the City Council on
July 13 and notice was sent to DNR.

Recommendation:

To ensure that the DNR has the full 30 days to review and comment, Staff recommends that this
public hearing be opened and convened to July 27. On July 27, City Council can close the public
hearing and adopt the proposed ordinance.

Council Action:

Motion by and seconded by to convene the public hearing
regarding amendments to the Shoreland Overlay District to July 27, 2004.

Review Checklist:

City Attorney
Assistant Community Development Director
Associate Planners
Hoisington Koegler

CC: 07/13/04
