CASE # <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR <br />AN OVERSIZED ACCESSORY BUILDING; <br /> CASE OF JAMES AND DIANA FEIGUM <br />By: Chris Anderson, Community Development Assis'tant <br /> <br />Background: <br /> <br />The City has received an application from James and Diana Feigum for a conditional use permit <br />to exceed the maximum allowable square footage for accessory buildings on properties between <br />1 and 1.99 acres as established in City Code on the property located at 6321 163~d Lane NW. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site layout <br />c) Site picture <br />d) Draft Planning Commission meeting minutes dated July 1, 2004 <br />e) Proposed findings of fact <br />f) Proposed conditional use permit <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to property owners within 350 feet of the <br />subject property. Staff sent out notices to all property owners within 350 feet. <br /> <br />Obserw~tions: <br /> <br />The subject property is approximately 1.2 acres (52,272 square feet) in size and is located outside <br />the Metropolitan Urban Service Area (MUSA). According to City Code, the property is eligible <br />l'br 1,664 square feet of accessory building space. <br /> <br />The proposed building will be 1,320 square feet (30' x 44') in size. Combined with the existing <br />attached garage (624 sq. ft.), the applicant would have 1,944 sq. ft. in accessory building space. <br />This results in an overage of 280 square feet. The applicant would like to exceed the size <br />restriction in order to construct a detached accessory building that would accommodate the <br />storage of private use vehicles and equipment. <br /> <br />The proposed accesso~3, building will be located in the rear yard, and will meet and/or exceed all <br />setbacks established in the R-1 Rural Developing District. <br /> <br /> <br />
