TOWN CENTER GARDENS <br /> DEVELOPMENT AGREEMENT <br />CITY OF RAMSEY, ANOKA COUNTY, MINNESOTA <br /> <br /> THIS AGREEMENT, made and entered into by and between the CITY OF RAMSEY, <br />a municipal corporation under the laws of the State of Minnesota (the "CITY"), and <br />BRIGHTKEYS DEVELOPMENT CORPORATION, a Minnesota corporation, whose <br />address is 1809 Northwestern Ave., Stillwater, MN 55082 ("DEVELOPER"). <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the DEVELOPER is the fee owner of the following described property <br />situated in the CITY OF RAMSEY, County of Anoka, State of Minnesota, and legally described <br />as follows: <br /> <br />Outlot B, Town Center Gardens, according to the recorded plat thereof, Anoka County, <br />Minnesota <br /> <br />or upon recording - <br /> <br />Lots 1-3, Block 1, Lots 1-4, Block 2, and Outlots A and B, Town Center Gardens 2na <br />Addition, Anoka County Minnesota <br /> <br />(the "Subject Property"); and <br /> <br /> WHEREAS, on July 22, 2003, the CITY approved the preliminary plat of the Subject <br />Property which plat is known as TOWN CENTER GARDENS (the "Plat"), which approval is <br />contingent on certain requirements, including the DEVELOPER and the CITY entering into <br />this Agreement; and <br /> <br /> WHEREAS, on October 14, 2003, the City Council approved the final plat for Town <br />Center Gardens; and <br /> <br /> WHEREAS, on June 4, 2004, the DEVELOPER submitted a final plat for Town Center <br />Gardens 2''d Addition (the Plat) and prepared by Pioneer Engineering; and <br /> <br />Town Center Gardens 2nd Addition Subdivision <br />Development Agreement <br /> Page 1 of 12 <br /> <br /> <br />
