Payment for Stage II Improvements. The CITY will install in the Plat the Stage II <br />Improvements. The DEVELOPER shall also deposit an amount that is determined by the <br />CITY to be adequate to aid in the operation and maintenance of street lights in locations <br />within the Plat determined by the City Engineer and installed by Connexus for the first three <br />(3) years after final plat approval. The CITY will bill residents in the Plat at least quarterly <br />for street light maintenance and operation costs; billing will be initiated at the time a <br />residence connects to municipal water and sanitary sewer. The DEVELOPER will pay to <br />the CITY an amount equal to 100% of the City Engineer's estimated construction cost of the <br />items prior to recording of the final Plat. The City Engineer's estimated cost of construction <br />is: <br /> <br />a) Street striping and signing ( 2 ~$200) <br />b) Traffic signing ( 2 ~$200) <br />c) Future Through Street Signing ( 2 ~$200) <br />d) Street lights ( 2 ~$ 3000) <br />e) Street Light Town Center Gardens) <br />f) Street light maintenance ( 2 ~$3000) <br />g) Street sweeping <br />h) Seal coating (3943 sq. yds ~$.85/sq. yd.) <br /> <br />$400.00 <br />$400.00 <br />$400.00 <br />$6000.00 <br />$15,000.00 <br />$600.00 <br />$300.O0 <br />$3,352.00 <br /> <br />("Stage II Improvements") <br /> <br />Tot~ $26,452.00 <br /> <br />10. Hard Surfaced Driveways. Hard surfaced driveways (bituminous or concrete) are a <br /> requirement for each lot in the Plat. Said improvement shall be installed by the building <br /> permit applicant or the homeowner at the time the Certificate of Occupancy is issued or as <br /> soon thereafter as possible, weather permitting. In the event this improvement is not timely <br /> installed on a lot, the DEVELOPER and/or the DEVELOPER'S assign(s), agrees that the <br /> CITY may install said improvement on the lot and specially assess the cost therefore against <br /> the lot. The DEVELOPER hereby waives all tight to a public heating and other statutory <br /> rights or City Charter tights granted a property owner relating to special assessments, <br /> including the right to appeal the special assessment for installation of the hard surfaced <br /> driveway. In addition, the DEVELOPER grants the CITY a license to enter on each lot of <br /> the Plat in order to install the improvement described in this paragraph if the same has not <br /> been previously constructed. <br /> <br />11. Street Cleaning. After the street surfacing is installed, the DEVELOPER shall clear any <br /> soil, earth, or debris from the streets within the Plat resulting from any construction within <br /> the Plat by the DEVELOPER or its successors and assigns. From time to time, the CITY <br /> may remove accumulations of soil, earth and debris from the streets resulting from the <br /> construction of the Plat. It shall be the DEVELOPER'S responsibility to pay the costs <br /> associated with this necessary street cleaning.
