Councilmember __ introduced the following resolution and moved for its adoption: RESOLUTION #04-07- A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO RAMDANCE LLC TO CONSTRUCT A BUILDING LARGER THAN 35,000 SQUARE FEET IN THE TC-2 ZONING DISTRICT AND DECLARING TERMS OF SAME: WHEREAS, Ramdance LLC, hereinafter referred to as the "Applicant," has properly applied t~or a Conditional Use Permit to construct a building larger than 35,000 square feet in the TC-2 Zoning District on property legally described as follows: Outlot l, Ramsey Town Center Addition, Anoka County, Miimesota ("Subject Property") WHEREAS, the Planning Commission met on July 12, 2004, conducted the public hearing and recommended City Council approval of the request. NOW TItEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: Based on Findings of Fact #__., a Conditional Use Permit (Permit) to construct a building larger than 35,000 square feet in the TC-2 Zoning District, is hereby granted to Ramdance, LLC, hereinafter referred to as the "Permittee". That the Permit only applies to the grocery store to be located in the future Lot 1, Block 1 of Ramsey Town Center 3rd Addition. 3. That the Permit only allows for an initial 54,000 square feet of building to be constructed. 4. That the Permittee is allowed to expand the building to a total of 63,000 square feet after receiving site plan approval for the expansion from the City. That the grocery store building shall be properly constructed and maintained in accordance with all applicable Staff Review letters, approved site plans, City Code, and Uniform Building Codes. 6. That this Permit shall be perpetual in duration as long as the terms are herein complied with. 7. That the Permittee shall be responsible for all City costs incurred in administering and enforcing this Permit. 47
