Voting No: None.

Case %10: Amendment To The On-Site Septic S~stem Ordinance, Chapter 150.01
(Sewage Disposal S~stems):

Mr. Berg stated that the proposed changes to the ordinance are to bring the
ordinance better into complaince with the State regulation, the Comprehensive
Plan and Metro Council; these agencies have reviewed our proposed revisions
and find them acceptable. The major change takes the financial responsibility
off of the City for inspections, p~nping, etc. The next step is to implement
the maintenance program. If the City intends to comply with the Comprehensive
Plan, it would have to perform a city-wide study of all septic systems, update
any deficient systems and assess the costs back to the property owners. If
the City wants to maintain on-site systems, the City is also going to have to
make sure the systems are taken care of.

Mayor Gamec stated that this is developing into an expensive program.

Mr. Berg replied that the people do not want municipal services and on-site
systems and the maintenance of them, is the alternative.

Mr. Schnelle stated that not complying could lead to legal problems.

Motion by Councilmember Van Wagner and seconded by Councilmember Schlueter to
amend Chapter 150.01 of the City Code entitled "Sewage Disposal Systems"
by substitution of the amended chapter as presented and by adoption of
Ordinance %84-2, which ordinance formally adopts the amendment to said
Chapter 150. (Please refer to ordinance file for Ordinance %84-2).

Further Discussion: Councilmember Schlueter stated that this ordinance will
bring the citizens and City together for well-maintained on-site systems.
City Attorney Goodrich cautioned against adopting an ordinance and not intending
to enforce it. Mayor Gamec stated that if health hazards are discovered
during inspections, the City could end up pushing sewer and water. Mr. Schnelle
replied that the City cannot allow the pollution of others. Councilmember
Sorteberg stated that he thinks the program will end up on a voluntary basis.

Motion carried. Voting Yes: Councilmembers Schlueter, Van Wagner, Reimann
and Sorteberg. Voting No: Mayor Ga/nec.

C/February 28, 1984
