I <br /> I <br /> I <br /> i <br /> I <br /> I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />! <br />i <br /> <br />Chairman Meitman stated that each type of project cannot be addressed An the <br />charter'because of continuous changes in the City; the charter can only provide <br />a skelton to go by. <br /> <br />Commissioner Data pointed out if the project is a local improvement, then only <br />those persons being assessed will have something to say about it. <br /> <br />Commissioner Sieber stated that administration costs incurred should be addressed <br />in 8.05.02 also. <br /> <br />Commissioner Gamec stated that assessments, technically, are cushioned to cover <br />administrative costs. <br /> <br />Mr. Darryl Fults - 15410 Barium - Developers are not in agreement with the <br />60 day wait required; from the day a developer puts up the money for a <br />feasbility study, the meter starts running. Will a notice be put out that <br />the 60 days has started? <br /> <br />Commissioner Bauerkemper stated that the public hearing marks the beginning of <br />the 60 days; there are a lot of requirements to be fulfilled by the developer <br />which could be accomplished during that 60 day wait. <br /> <br />Mr. Fults pointed out that the developer already has a lot of money invested <br />by the time of the public hearing. <br /> <br />Chairman Heitman requested that the 60 day wait issue be discussed later in <br />the evening, that the discussion at this time should be regarding 8.05.02. <br /> <br />Mr. Darryl Fults inquired as to how this section would apply to a developer <br />putting in sewer and water. <br /> <br />Commissioner Sieber stated that in almost all cases where a developer requests <br />an improvement, it is going to be 100% assessed out anyway. Developers <br />expect to have those improvements paid for out of assessments to the individual <br />parcels. <br /> <br />Mr. Fults stated that these are very complex issues and at times the City does <br />participate in the cost of the improvements. <br /> <br />Commissioner Sieber suggested the following modification to Section 8.05.02: <br /> <br />In the third line, between the words 'assessment' and 'within', add the <br />following phrase: 'excluding minor ordinary expenses incurred in the <br />normal course of City affairs'. <br /> <br />The Commission was in agreement with this modification. <br /> <br />Commissioner Sieber suggested the following modification to Section 8.05.02: <br /> <br />In the fifth line, delete the phrase 'equal to at least 25%' and replace <br />with 'greater than 50%'. Between the words 'in' and 'registered', insert <br />the phrase 'n~her of'. <br /> <br />The Commission was in agreement with this modification. <br /> <br />Commissioner Sieber stated that he has a suggestion regarding local improvements <br />on city owned property not being subject to petition, but he would like to <br />hear Mr. Schnelle's comments on this section first. <br /> <br /> <br />
