The Minnesota Environmental Response and <br />Liability Act, Minnesota Laws, 19~3, Chapter 115B (ERLA of State superfund) <br />requires the MPCA to establish a permanent list of priorities among releases or <br />threatened releases of hazardous substances, pollutants or contaminants. The <br />MPCA s~aff believes that your landfill nas a release or threatened release of <br />hazardous substances,.pollutants or contaminants based upon the ground water <br />monitoring data from your landfill or the types of wastes that have been <br />disposed of at your landfill. . <br /> <br /> Being listed on the State superfund list 'does not necessarily mean that a <br /> landfill owner or operator is violating any regulation or is required to <br /> undertake any immediate action. Inclusion of your landfill on the State <br /> superfund list does mean that an investigation of the impacts of your landfill <br /> on the environment will be required by the MPCA in the future. Also being <br /> included on the State superfund list serves as a notice to you as a responsible <br /> party for the landfill that if you are unwilling or unable to do the <br /> investigatory or clean up work needed at the landfill when asked to by the'MPCA, <br /> the MPCA may conduct the necessary investigatory or clean up work and then seek <br />· to recover reimburs~nent of our costs from the responsible partylies) once the <br /> work is completed. , ~ <br /> <br />Before the State superfund list is established, the MPCA is required to publish <br />the proposed list in the State Register and allow 30 days for comment by the <br />public.
