MICRAEL

Mr. Schafer is requestin9 a variance to construct a 720 square foot
garage and locate it in his front yard. ~he City Ordinance restricts
accessory buildings to a maximum size of 624 square feet on a parcel
of this size. However, Mr. Schafer will not exceed the total allowa-
ble area (1,488 square feet) for both detached and attached accessory
buildings. ~he area of his existing attached garage is 624 square
feet. City Ordinance also requires that accessory buildings in resi-
dential districts be located in the rear or side yard. Mr. Schafer
has stated that the proposed accessory building must be located in the
front yard because be bas no access to the rear yard due to the topo-
graphy of his lot.

~he City received a l~hone call from an adjacent property owner stating
an objection to the location of the proposed accessory building. ~ne
City also received a note from Mr. and Mrs. Henry Myhre stating that
they had no objection to the garage if it is to be used solely for the
storage of personal property, but they would object if the garage is
to be used for the storage or operation of any commercial-type busi-
ness. We have also received a petition from residents in the area who
are opposed to Mr. Schafer locating the garage in his front yard and
also oppose any oom~ercial use. Ms. Judy McCaslin sent us a letter
with the same concerns as those above.

~he followirg items are contained in enclosure (D4-a) for your consi-
deration:

a) Applicant's application
b) Public hearing notice
c) List of properties notified
d) Site location map
e) Letter from Mr. and Mrs. Myhre
f) Petition opposing accessory building
g) Letter from Ms. Judy McCaslin
h) Proposed findings of fact
i) Proposed development agreement
j) Letter from City Planner Norris to Mr. Schafer

Oouncil Action: Your action will be to approve/disapprove/amend the
proposed fir~]ings of fact as well as to approve/disapprove of the re-
quest. ~e following proposed motions are hereby submitted for your
consideration:
