I <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />FACT 0094 <br /> <br />1) That the Applicant properly applied for a Board of Adjustment variance to <br />construct a detached accessory building larger than allowed in the City Ordi- <br />r~nce. <br /> <br />2) ~hat the Applicant appeared before the Board of Adjustment for a public <br />hearing on November 13, 1984, and that said public hearing was properly adver- <br />tised and that the minutes of said public hearing are hereby incorporated as a <br />part of these findings by reference. <br /> <br />3) ~hat the Applicant's property is generally known as 8270 - 168th Lane Nh' <br />and is located in the R-1 district. <br /> <br />4) ~hat the Applicant's property is approximately 1 acre in size. <br /> <br />5) ~hat the Applicant's request is to oonstruct an accessory structure of 24' x <br />36' (864 square feet) in size. <br /> <br />6) ~at the City Ordinance restricts accessory buildings to a maximum size of <br />624 square feet on parcels of land of less than 2.5 acres. <br /> <br />7) ~hat there are not exceptional, unique of extraordinary circumstances or <br />oonditions applying to the property in question as to the intended use of the <br />property that do not apply generally to other propertise in the same zoning dis- <br />trict. <br /> <br />8) ~at such variance is not necessary for the preservation and enjoyment of a <br />substantial property right similar to that possessed by other properties in the <br />same district and in the same vicinity. ~he possibility of increased financial <br />return shall not in itself be ~Jned sufficient to warrant a variance. <br /> <br />9) ~hat the authorizing of such variance will not be of substantial detriment <br />to adjacent property and will not materially impair the intent and purpose of <br />this ordinance or the public interest. <br /> <br />10) ~at the condition or situation of the specific piece of property, or the <br />intended use of said property for which the variance is sought, is not of so <br />general or recurrent a nature as to make reasonably practicable the formulation <br />of a general regulation for such conditions or situation. <br /> <br />11) ~hat the variance observes the spirit and intent of this ordinance, pro- <br />duces substantial justice and is not contrary to the public interest. <br /> <br />12) ~hat properly constructed, the building would comply with the requirements <br />of the State Building Code. <br /> <br />13) ~hat the Applicant has agr~-~cd to enter into an agreement with the City of <br />Ramsey guaranteeing the conditions of his develoI2~ent. <br /> <br /> <br />
