The statute_ does, however, provide a <br />mechanism to allow that type of development which the Metropolitan Council <br />finds to be consistent with possible sanitary landfill operation on adja- <br />cent lands. This mechanism is also set forth in MS 473.806 and is referred <br />to as an abrogation of the development limitation. If a property owner <br />whiches to develop a buffer property, he must submit a request to the Metro- <br />politan Council for an abrogation of this development limitation. The <br />Metropolitan Council will then solicit the comment of the county as to <br />whether the county approves or disapproves of the proposed development. The <br />type of development proposed must be a type of development that is permitted <br />under the local official controls an~ which is compatible with sanitary landfill <br />operation on adjacent property. The proposed use cannot be one which would <br />tend to reduce the quality of the inventory site as compared to the other <br />sites on the inventory. <br /> <br />If the proposed development is that of a solid waste facility, plans and <br />specifications must be also prepared and submitted to the county and the .ii~,::i <br />Minnesota Pollution Control Agency for purposes of licensing and permitting. ='~ <br />It is my recommendation that if such an operation is being proposed that the <br />proponent should prepare a preliminary or conceptional plan which would show <br />generally the nature of the facility to be provided including a narrative <br />type of description outlining the operation of the facility. Such a prelimin- <br />ary/conceptional plan would be most helpful in determining whether or not the <br />proposed development would be compatible for purposes of abrogating the de- <br />velopment limitation and would benefit the proponent in that it would permit <br />the reviewing authorities to comment on the proposal before the preparation <br />of costly final plans. <br /> <br />If you have any questions concerning this matter, or if I might be of any <br />service to you, please feel free to call me. <br /> <br /> Sinc~erely, , j ; , <br /> <br />cc: Commissioner Baas <br /> <br />Director, Environmental Services <br /> <br /> <br />
