~e Commission recessed at 10:15 p.m. <br /> <br />Chairman Heitman called the ~eeting back to order at 10:39 p.m. <br /> <br />Motion by Commissioner Lichter and seconded by Commissioner Bauerkemper <br />to adopt Section 7.05.02 as is. <br /> <br />Further Discussion: Commissioner Greenberg stated that the Commission <br />brought in a person of expertise and that person recommended not <br />requiring 5 years and Commissioner Greenberg also feels that this <br />Commission should not dismiss that advice. Commissioner Sieber stated <br />that the Commission is not dismissing that advice, but Mr. Burggraaff <br />does not live and pay taxes in Ramsey. Commissioner Data stated that <br />Mr. Burggraaff's comments were valid for what the Commission did have <br />written down prior to revisions that were made; this Commission has <br />now redefined budget summary as income and expenditures and it is a <br />summary and Mr. Burggraaff's comments no longer apply. Commissioner <br />Gamec stated that it should be defined in the charter that the first <br />two years should be detailed and the last three years are estimates. <br />Commissioner Bauerkemper disagreed with Commissioner Gamec. Chairman <br />Heitman stated that the charter puts in the basics and the rest is to <br />Council's discretion. Commissioner Sieber noted that the Long Term <br />Plan is adopted by ordinance. Commissioner Bauerkemper explained that <br />this would allow citizens a voice if they don't like the direction of <br />the plan. Commissioner Gamec stated that doing it by ordinance could be <br />a problem; the time to say either a project is right or wrong is when <br />the feasibility studies are complete. Commissioner Gamec also pointed <br />out that it would be possible for a group of citizens to disagree with <br />an item in the Long Term Plan, Council would explain that it is only a <br />plan, the ~itizens would reply that it is an ordinance, and the whole <br />Long Term Plan could be forced to an election. Commissioner Titterud <br />inquired as to how changes in the plan would be handled. Commissioner <br />Bauerkemper replied that the Long Term plan can be changed every year. <br />~ommissioner Sieber stated that whether it is subject to referendum or <br />not does not have a long term legal affect because it can be amended <br />anyway; it allows the people a voice and forces council to listen; the <br />citizens have no say in the matter if it is done by resolution. <br />Commissioner Gamec replied that the citizens do have a say in the matter <br />if it is by resolution -- at the time the project comes up. Chairman <br />Heitman stated that assuming just because it is adopted by ordinance <br />there will be an election is wrong; if the plan is a good oil, there <br />won't be an election. Commissioner Sieber commented that a 5 year plan <br />or an amended 5 year plan, that is a result of a referendum, is immuned <br />to council action forever. Commissioner Sieber suggested adding a clause <br />to the effect that any 5 year plan that is a result of initiative and <br />referendum is immuned to council action for one year. <br /> <br />Motion carried. Voting Yes: Chairman Heitman, Commissioners Sieber, <br />Data, Lichter, Bauerkemper, Titterud. Voting No: CommissiDners Gamec <br />and Greenberg. Absent: Commissioner Buchanan. <br /> <br />Commissioner Lichter stated that he is uncomfor%able with a topting the <br />Long Term Plan by ordinance; adopting by ordinance becomes a law and <br />it is only a plan. <br /> <br />Commissioner Sieber stated that adopting by ordinance give ~he citizens <br />a Voice regarding city planning direction. <br /> <br />CC/December 8, 1983 <br />Page 5 of 8 <br /> <br /> <br />
