Councilm~[ mack~ the motion to adopt the fo]]c~Jng findings of fact: <br /> <br />FINDINGS OF FACT 01.._ <br />OONNIE SKA}~SAKKA <br /> <br />1. ~hat Ms. Connie Skarbakka, hereinafter referred to as "Applicant," has <br />properly applied for a c~ndiLtonal use permit to operate an acoountlng business <br />from her home at 17811 Gibbon Street N.W. <br /> <br />2. ~hat the Applicant appeared before the Planning and Zoning C~-,i, dssion fo~ a <br />public hearing pursuant to city Ordinance on February 4, 1986 and that said <br />public hearing was properly advertised and minutes of that public hearin9 are <br />hereby inoorporated by reference. <br /> <br />3. ~hat the subject property is legally described as follows: <br /> <br />Lot 10, Block 1, Deerwood, Anoka Oounty, Minnesota. <br /> <br />4. ~hat the subject property is located within the R-1 Residential District <br />and is approximately 5.5 acres in size. <br /> <br />5. ~hat the Standards for ~onsiderat~on are as follows: <br /> <br />a. ~hat the property is zoned R-1 Residential and an accounting business <br />is not a permitted use in this zone; <br /> <br />b. ~hat the adjoining property is either residential or vacant; <br /> <br />c. ~hat there are no other similar uses in the area; <br /> <br />d. ~hat the proposed use will not create an increase in traffic flow in <br /> the area; and <br /> <br />e. ~hat the proposed use will not be dangerous or otherwise detrimental to <br />persons residing in the area, or to the public welfare, nor will the <br />proposed use substantially impair the use, enjoyment or value of any <br />property in the area. <br /> <br />6. ~hat the Criteria for Approval are as follows: <br /> <br />a. ~hat the operation of the accounting business will not be detrimental <br />to or endanger the public health, safety or general welfare and is not <br />contrary to the established standards, regulations or ordinances of other <br />govermmental agencies; <br /> <br /> b. 7hat the acoounting business will not be unsightly, undesireable or <br />obnoxious in appearance and it will not hinder the orderly and harmonious <br />development of the City or the R-1 Residential District; <br /> <br />c. ~hat the accounting business will not be injurious to the permitted <br />uses nor unduly restrict the enjoyment of other property in the immediate <br />vicinity nor substantially diminish and impair property values within the <br />area; <br /> <br /> <br />
