5. ~hat the SUmdards for Oonsideration are as follows: <br /> <br />a. ~hat the property is zoned UER - Urban Existing Residential and a folk <br />art Instruction and supplies business is not a permitted use in this zone; <br /> <br />b. ~l~at the adJointr~ p~operty to the north is vacant and is zoned UMB <br />[~rban Multiple Business and the remaining adjoining property <br />restOent3al; <br /> <br />c. ~hat there are .o similar uses in the area; <br /> <br />d. ~hat the proposed use will not create a significant increase in traffic <br />flow in the area; ar~ <br /> <br />e. ~hat the proposed use will not be 4angerous or otherwise detrimental to <br />persons residing in the area, or to the public welfare, nor will the <br />proposed use substantially impair the use, enjoyment or value of any <br />property in the area. <br /> <br />6. ~hat the Criteria for Apixoval are as follows: <br /> <br />a. ~hat the operation of the proposed use will ,st be detrimental to or <br />endanger the public health, safety or general welfare and is not contrary <br />to the established standards, regulations or ordinances of other <br />goverm~.ntal agencies; <br /> <br />b. ~at the proposed use will ~ot be t~sightly, ur~esireable or obnoxious <br />in appearance and it will not hirzler the orderly and harmonious develol~ent <br />of the City or the PER -Orban Existing Residential District; <br /> <br />c. ~hat the proposed use will not be injurious to the permiited uses nor <br />unduly restrict the enjoyment of other property in the immediate vicinity <br />nor substantially diminish and impair property values within the area; <br /> <br />d. ~hat the establisl~nt of the proposed use will not impede the orderly <br />and normal develotment and improvement of the surrounding property for uses <br />permitted in either the UMB - Urban Multiple Business or I]ER - Orban <br />Existing Business Districts; <br /> <br />e. ~hat adequate water supply and sewage disposal facilities shall be <br />provided by the Applicant; and <br /> <br />f. ~hat the proposed use will conform to all applicable regulations of the <br />UER- Urban Existing Residential District. <br /> <br />7. ~hat the Performance Standards are as follows: <br /> <br />a. ~hat fire protection is provided by the cities of Anoka ar~] Elk River, <br />and that the proposed use will not create a fire hazard; <br /> <br />b. ~hat ~he proposed use will not create any electrical disturbance; <br /> <br />c. ~hat the proposed use will not create any noise disturbanoe; <br /> <br />-2- <br /> <br /> <br />
