Hours of operation shall be between the hours of 6:00 a.m. and
8:00 p.m. for (~mp~my vehicles.'

(k~issioner Sh~way stated that he doubts Mr. Knudson will be able to store
the 5 trucks, 2 bobcats, farm tractor, etc. in a 44' x 60' pole building.

Commissioner He~driksen stated that this Cc~mission has to make a decision as
to whether or not all of these items can be stored in the pole building and if
not, a decision has to be made as to whether or not another on-going liability
will be created for the City. O~mmissioner Hendriksen stated that he doesn't
feel that the fact that there is an existing pole barn at this location should
enter into the decision.

Motion by Commissioner Hendriksen and seconded by Gom~issioner Sh~way to
reco~end denial of Mr. Wayne Knudson's request for a conditional use permit to
operate his cement contracting business from his home at 15401 Armstrong Blvd.

Motion failed. Voting Yes: C~mmissioners Sh~,way, Hendriksen and Howell.
Voting No: ~hairman Peterson, (km~issioners Zimmer, De~mer and LaDue.

Motion by Commissioner LaP~e and seconded by Commissioner De~mer to rec~
approval of Mr. Wayne Knudson's request for a conditional use permit to operate
his cement contracting business fr~m his h~me at 15401 Armstrong Blvd. N.W.
contingent upon Mr. Knudson entering into a conditional use permit agreement
with the City.

Further Discussion: Commissioner ~-~er ~oted that Mr. Knudson has been above
board regarding his intended use of the pole building and is attempting to
operate legally, unlike many other situations in Bamsey. C(m~issioner LaDue
stated that Mr. Knudson's application should be taken in good faith and
judgement should not be made based on p~st p~obl~s in the ~eighborhood.
Co~missioner Sh~m~ay questioned how the Commission can consider recommending
approval when no public spoke out in favor of the request. G~airman Peterson
stated he thinks the public was under the ass~ption that a 'cement
contracting' would be c~mp~rable to a oement ready-mix business. G0~issioner
LaDue stated that he doesn't see any of Mr. Knudson's operation being
detrimental to neighboring property owners. Ms. Norris stated that with
respect to sufficient space being provided for storage of equipment with the
existing pole building, Mr. Knudson can add on additional acoessory structure
space up to the maxim~ limits, but that additional space cannot be ~sed for
company vehicles. Commissioner LaDue noted that the fact the accessory
structure already exists did not enter into his decision to make this motion.

Motion carried.
