Commissioner Bauer introduced the following resolution and moved for its adoption: <br />RESOLUTION #16-05-106 <br />RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO CONSTRUCT A <br />DETACHED ACCESSORY BUILDING WITHIN THE ORDINARY HIGH WATER <br />LEVEL SETBACK, NEARER THE FRONT LOT LINE THAN THE HOME AND TO <br />CONSTRUCT A SECOND DRIVEWAY. <br />WHEREAS, Gregory and Rachelle Binfet, hereinafter referred to as the "Permittee," have <br />properly applied for a variance from Sections 117-225 (Shoreland Overlay District development <br />standards), and 117-111 (R-1 Residential District) of the Ramsey City Code to construct a detached <br />accessory building within the established Ordinary High Water setback as well as nearer the front <br />lot line than the home, and to construct a second driveway on the property generally known as <br />14301 Neon Street NW and legally described as follows: <br />Lot 2, Block 1, Chestnut Woods. <br />(the "Subject Property"). <br />WHEREAS, the Planning Commission conducted a public hearing on June 2, 2016, <br />pursuant to Section 117-53 of the Ramsey City Code. <br />NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That based on Findings of Fact #0936, a Variance to construct a detached accessory building <br />(the "Building") within the required setback to the Ordinary High Water (OHW) line of <br />Ramsey Terrace Pond, as well as nearer the front lot line than the home, and to construct a <br />second driveway on the Subject Property is hereby granted. <br />2. That the Building shall not be located any closer than 29.25 feet from the OHW on the Subject <br />Property as shown on Exhibit A. <br />3. That the Permittee shall construct the Building in accordance with all other provisions of City <br />Code Section 117-349 (Accessory Uses and Buildings). <br />4. That the Permittee is responsible for accurately locating the front, street facing property line <br />and the property line parallel to it, of the Subject Property (survey markers exposed) and <br />having them clearly marked for the City to verify the front and side yard setback distances at <br />the time of the footing inspection. <br />5. That the Permittee shall be responsible for all costs incurred in administering and enforcing <br />this Variance. <br />6. That the Permittee shall obtain all necessary permits prior to commencing any construction of <br />the Building, including a Building Permit. <br />
