That Mr. Robert Sylvester smd the Cross of Rope Lutheran Church, <br />hereinafter referred to as "Applicant," has properly applied for a conditional <br />use permit to construct smd operate a cemetery from the property at 5730 179tb <br />Lane ~.W. <br /> <br />2. That the Applicant appeared before the Ramsay Planning and Zoning <br />Commission for s public bearing pursuant to Section 170.016 of the City Code o~ <br />April 14, 1986 and that said public hearing wss properly advertised and <br />minutes of that public hearing are hereby incorporated by reference. <br /> <br />3. That the property which is the subject of the application is located at <br />5730 179th Lane H.W. and is legally described &s follows: <br /> <br />The South 5 acres of the West 10 acres of the East 20 acres of Lot <br />AUDITOR'S SUBDIVI~IO~ I~I(BER 27, Anoka County, Hinnesota. Subject to the <br />rights of the public in and to County State Aid Highway 1~o. 7. Subject to <br />an easement to the ~oka County Cooperative Light and Power Association <br />· ecorded in look 174, P~e 261 ms Document ~o. <br /> <br />-and- <br /> <br />The South 5 acres of the East 10 acres of the East 20 acres of Lot l, <br />AUDITOR'S SUBDI¥ISIO) NUIiBiR 27, Anoka County, ~innesota. Subject to the <br />rights of the public in and to County State Aid Righway ]o. 7. Subject to <br />an easement to the lnoka County Cooperative Light and Power Association as <br />recorded in Book 17&, Page 261 as Document No. 9935&. <br /> <br />4. That the subject property is approxiaately 10 acres in size and is located <br />in the R-1 residential district. <br /> <br />That the Standards for Consideration are as follovs: <br /> <br />a. That the property is zoned R-1 residential and a cemetery is not a <br /> permitted use in this district; <br /> <br />b. That the adjoining properties are zoned residential and are occupied by <br /> residential structures, church structures or are vacant; <br /> <br />c. That there is a similar use, a cemetery which is no longer used, in the <br /> R-1 residential district; <br /> <br />d. That the proposed cemetery would not create a permanent, significant <br /> increase in traffic flow to the area; <br /> <br />e. That the proposed cemetery will not be detrluental to persons residing <br /> in the area or to the general public; and <br /> <br />f. That in the R-1 residential district, the minimum residential lot size <br /> is 2.5 acres. <br /> <br /> <br />
