QUAD CITIES CABLE COMMUNICATIONS COMMISSION <br /> RESOLUTION RECOMMENDING APPROVAL <br /> OF CENTURYLINK CABLE FRANCHISE APPLICATION <br /> WHEREAS, the cities of Andover, Anoka, Champlin, and Ramsey, Minnesota("Cities") <br /> are members of the Quad Cities Cable Communications Commission ("Commission"), a <br /> municipal joint powers entity organized by an agreement pursuant to Minn. Stat. § 471.59, as <br /> amended, and; <br /> WHEREAS, the Cities enacted substantively identical ordinances granting cable <br /> television franchises (collectively, the "Franchise") authorizing the provision of cable television <br /> services within the Cities; and <br /> WHEREAS, as a result of several transfers, Comcast of Minnesota, Inc. ("Comcast") <br /> currently holds the Franchise; and <br /> WHEREAS, the Commission administers and enforces the Franchise and provides <br /> community programming and certain other cable-related services on behalf of the Cities, and; <br /> WHEREAS, the Commission has adopted a policy governing the processing and <br /> potential issuance of competitive cable franchises by the Cities, and; <br /> WHEREAS, the Commission is responsible for processing initial cable franchising <br /> requests and making associated recommendations to the Cities; and <br /> WHEREAS, the Cities retain final authority to approve and enact any initial franchise(s), <br /> and; <br /> WHEREAS, at the request of Qwest Broadband Services, Inc. d/b/a CenturyLink <br /> ("CenturyLink"), the Commission initiated the process for considering issuance of initial <br /> competitive cable franchises under Minnesota law, Minn. Stat., Ch. 238, and; <br /> WHEREAS,the Commission received a timely franchise application from CenturyLink <br /> dated June 3, 2015, and; <br /> WHEREAS, the application was considered by the Commission at a duly-noticed <br /> public hearing on June 18, 2015, and; <br /> WHEREAS, at the hearing, CenturyLink gave a presentation regarding the application <br /> and its proposed "Prism" video services, and the Commission received Comcast's written <br /> comments dated June 17, 2015 concerning the application, and; <br /> WHEREAS, federal law (47 U.S.C. § 541(a)(1)) provides that a franchising authority <br /> may not grant an exclusive cable franchise and "may not unreasonably refuse to award an <br /> 488457v1 RJV QU210-6 <br /> 1 <br />
