Subscribers for any basic, optional, premium, per-channel, or per-program service, or other <br /> Cable Service as defined under applicable law; Installation, disconnection, reconnection, <br /> and change-in-service fees; Lockout Device fees; Leased Access Channel fees; late fees <br /> and administrative fees; fees, payments or other consideration received from programmers for <br /> carriage of programming on the System and accounted for as revenue under Generally <br /> Acccepted Accounting Principles; revenues from rentals or sales of Set Top Boxes or other <br /> equipment; fees related to commercial and institutional usage of the System; net advertising <br /> revenues; interest; barter; revenues from program guides; franchise fees; and revenues to the <br /> System from home shopping, bank-at-home channels and other revenue sharing <br /> arrangements. Gross Revenues shall include revenues received by an entity other than the <br /> Grantee, an Affiliate or another entity that operates the System where necessary to prevent <br /> evasion or avoidance of the Grantee's obligation under this Franchise to pay the franchise fee. <br /> Gross Revenues shall not include: (i) to the extent consistent with generally accepted <br /> accounting principles, actual bad debt write-offs, provided, however, that all or part of any <br /> such actual bad debt that is written off but subsequently collected shall be included in Gross <br /> Revenues in the period collected; (ii) any taxes on services furnished by the Grantee imposed <br /> by any municipality, state or other governmental unit, provided that franchise fees shall not <br /> be regarded as such a tax; (iii) FCC regulatory fees; (iv) Subscriber credits, adjustments or <br /> refunds; or(v)refundable Subscriber deposits. <br /> 1.20 "Installation" means the connection of the System from feeder cable to the point of <br /> connection with the Subscriber Set Top Box or other terminal equipment. <br /> 1.21 "Leased Access Channel" means channels on the System which are designated or <br /> dedicated for use by a Person unaffiliated with the Grantee pursuant to 47 U.S.C. § 532. <br /> 1.22 "Living Unit" means a distinct address as tracked in the QC network inventory database, <br /> used by Grantee to identify existing or potential Subscribers. This includes,but is not limited <br /> to, single family homes, multi-dwelling units (e.g., apartment buildings and condominiums) <br /> and business locations. <br /> 1.23 "Lockout Device" means an optional mechanical or electrical accessory to a Subscriber's <br /> terminal which inhibits the viewing of a certain program, certain channel, or certain <br /> channels provided by way of the Cable System. <br /> 1.24 "Mosaic Channel" means a channel which displays miniaturized media screens and related <br /> information for a particular group of channels with common themes. The Mosaic Channel <br /> serves as a navigation tool for Subscribers, and, with respect to PEG Channels, displays the <br /> group of access channels on a single channel screen and also provides for easy navigation to a <br /> chosen access channel in the group. <br /> 1.25 "Remote Terminal" means a facility that is located in a neighborhood, which houses the <br /> electronics used to support the provision of Cable Services. <br /> 1.26 "Noncommercial" means, in the context of PEG channels, that particular products and <br /> services are not promoted or sold.
