Councilmember Williams introduced the following resolution and moved for its adoption: RESOLUTION #16-09-154 A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT FOR AN OVERSIZED ACCESSORY STRUCTURE. WHEREAS, Jason and Susan Nordquist, hereinafter referred to as the "Permittee" have properly applied for an amended Conditional Use Permit to construct an oversized detached accessory structure at the property located at 8855 176th Avenue NW and legally described as follows: LOT 1, BLOCK 1, COUNTRYSIDE ESTATES, Anoka County, Minnesota. ("Subject Property") WHEREAS, the Planning Commission met on September 1, 2016, conducted the public hearing and recommended City Council approve/deny the request. NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. That based on Findings of Fact #0966, a Conditional Use Permit (the "Permit") for oversizing an accessory structure is hereby granted to the Permittee. 2. That this Permit specifically allows the Permittee to exceed the maximum amount of square footage allowed for accessory buildings on the Subject Property by a total of 824 square feet, allowing for construction of a 2,400 square foot detached accessory building (the "Building"). 3. That there shall be no additional accessory structures constructed on the Subject Property, unless in accordance with City Code. 4. That the Permittee shall construct the Building in accordance with all other provisions of City Code Section 117-349 (Accessory Uses and Buildings). 5. That the Permittee shall extend the existing second driveway to provide access to the Building from Vicuna Street and that the driveway shall comply with the standards in City Code Section 117-111. 6. That the Permittee agrees that there will not be any commercial activities within the detached accessory building unless in full compliance with City Code Section 117-351 (Home Occupations). 7. That this Permit shall be perpetual in duration as long as the terms are herein complied with.
