WAYNE SWEDAL ~ne Sorris, C~unity Develo~ent Director Backgroundt Mr. Wayne Sweda! owns three lots (Lots 13) 14 and 15) in Bowers Mississippi Acres. Nr. Swedal purchased this property in 1966 with the understanding that all three lots were developable. Subsequent to this sad due to changes in river development controlss Mr. Swedal entered into an ~reement with the City and l/QB restricting development to one lot until such time as water and sever were available to the re~aining two lots. In 1982 the City made street improvements to Bowers Drive 1F~ and assessed all three of Mr. Swedal's lots for these improvements. Hr. Swedal requested that the City Council rescind the develo~nent restriction on the tvs vacant lots if the City assessed these lots for improvement. The Council agreed with Mr. Swedal, determined that the two lots were buildable and agreed to rescind the development restriction on Lots 13 and 15. However, due an administrative oversight, this action vas never referred to the l/QB for their review and ac t ion. Mr. Swedal would now like to sell the two vacant lots. In order to do this, the City and I/QB need to agree to release these lots from the development restriction. l/nclosed for your information is a map shoving Hr. Swedal*s property. Ob servations: City Administrator Hartley and I met with the EQB and Mr. Svedal to discuss this matter. The EQB and City have agreed that they have no objections to releasing Mr. Swedal's lots from the development restriction. Recommendation: Council Action: Motion to: Authorize the Hayor and City Administrator to enter into an agreement with the l/QB and Mr. Wayne Swedal to release Lots 13 and 15 from the development restriction.
