Absent: Commissioners ~hum~ay <br />and Rendriksen. <br /> <br />Discussion ~ardin~ Plants And Thin?a: <br /> <br />Commissioner Deemer referred to page 16 of July 22, 1986 Council sinutes and <br />noted that City Council reversed Planning and Zoning action in the case of <br />Plants and Thin/s; Councilne~ber Cox ai~ed comments at Co~issioner Dee~er in <br />particular. Commissioner Deemer stated that on Narch 19, 198~ there was a <br />special Plannin~ and Zoning meetin~ (which happens to be the day construction <br />of the new buildi~ began at Plants and ~i~s), at which time he brought it to <br />the attention of the P~Z and City Staff that the buildinE vas not up to code. <br />For various reasons, construction of the buildiuE vas never stopped. <br />C~issioner De,er stated that Nr. Bic~an relied upon paci~ by the buildi~ <br />inspector to dete~ine that setbacks were ~et ~nd the probl~s multiplied fr~ <br />that point on. C~issioner De,er state~ that he att~pted to contact the <br />~yor and could not 8et in touch with the City Attorney until it vas too late <br />to stop construction. C~issioner De,er stated that he did talk to foyer <br />Buildin~ Inspector Clayton Ber~ and Hr. Ber~ cla~s that N~. Hic~an first <br />applied for a building pe~it when he vas still on staff at ~sey; he told <br />Hic~au that a certified site plan vas required. ~erefore, N~. ~ic~an did <br />kn~ what vas required but took advantaEe of a loop hole and ~rratic conditions <br />at City Hall. C~issioner De~er noted that on July 22~ 19~, Council~er <br />Cox abstained fr~ votini on an issue because of a person1 disaire~ent with <br />one of the participants in the case. ~ that basis, Councilm~er Cox should <br />not vote on issues that have participants with which he has a ~rso~l <br />agre~eent; maybe Nr. Cox should not be on Council if he can*t separate <br />person1 issues fr~ business. C~issioner De,er stated that he resents <br />Councilm~er Cox' inference that he is *picki~ on Nr. <br /> <br />Ns. Norris stated that she and Council~her Cox have met with ~r. Hich~an <br />regarding items of concern listed in City Attorney ~emo dated June 3, 1986. <br />Nr. Bick~an agreed to surface parking lot and driveways on his own ti~e line; <br />to appropriately ~ark parking areas, improve exterior appearance of ney <br />structure and provide a non-certified site plan. <br /> <br />Notion by Chairman Peterson and seconded by Commissioner Bovell to recommend <br />that Hr. Larry lick~nan be required to fulfill the certified site plan <br />requirement, just as any other person in Ramsey is required to do; and that if <br />any variances from that site plan requirement are granted, the reasons for <br />doing so be spelled out in ~otion for~. <br /> <br />Further Discussion: Chairman Peterson stated that idor~ation gained from the <br />certified site plan (lot dimensions, building size and location) determine the <br />amount of parking area that viii be required; reasons for waiving that <br />requirement should be public record. <br /> <br />A~endment by Commissioner LaDue and seconded by Commissioner Zi~er~an <br />acknowledging that Com~nissioner Deemer was not acting independently beyond <br />authority as a ~m~er of the Planni~ and ioni~ C~issionI that <br /> ~gust 5, 19~ <br /> <br /> Page 10 of 11 <br /> <br /> <br />
