Goodrich - City Attorney <br />Mayor He~tman's Resignation <br />August 5, 19B6 <br /> <br />You have advised me that Mayor Heltman lntends to resign his <br />electlve office as Mayor of the City of Ramsey because he has <br />sold hls home and Is no longer a Ramsey resident. <br /> <br />The questions this memorandum is therefore addressing are: <br /> <br />Upon what event does Mayor Heitman cease to be <br />Mayor of the City of Ramsey and how and when is <br />the vacancy to be filled. <br /> <br />Sections 2.03 and 2.05 of the City Charter provide in part: <br /> <br />Section 2.03. Council Composition and Election. <br />The council shall be composed of a Mayor and four <br />council members who shall be elected at laroe. <br />. . the mayor shall serve for a term of two years <br />and/or until a successor is elected and qualifies. <br /> <br />Section 2.05. Vacancies. A vacancy in the council, <br />whether it be in the office of Mayor or council- <br />member, shall be deemed to exist in the case of <br />· . . resignation in writing flled with the Clerk- <br />Administrator, . . . non-residence in the City <br />· . . In each such case the counc11 shall by resolu- <br />tion declare the vacancy and such vacancy shall <br />be filled according to the provisions of section <br />4.05. <br /> <br />The City Charter makes no provision for defining residency, <br />however, MSA 200.031, Determination of Residence, gives some <br /> <br /> <br />
