PROPOSED FINDINGS OF FACT <br />CHILDREN OF HOPE EARLY EDUCATION CENTER <br /> <br />1. That Children of Rope Early Education Center, hereinafter referred to as <br />"Applicant," has properly applied for a conditional use permit to operate an <br />early education center in the R-IR Residential district. <br /> <br />2. That the Applicant appeared before the Planning and Zoning Commission for a <br />public hearing pursuant to Section 170.013D of the City Code on September 2, <br />1986 and said public hearing was properly advertised and minutes of that public <br />hearing are hereby incorporated by reference. <br /> <br />3. That the property which is the subject of the application is located at <br />5730 179th Lane N.W. and is legally described as follows: <br /> <br />The West 10 acres of the East 20 acres of Lot 1, AUDITOR'S SUBDIVISION <br />NUMBER 27, Anoka County, Minnesota. Subject to the rights of the public <br />in and to County State Aid Righway No. 7. Subject to an easement to the <br />iaoka County Cooperative Light and Power Association as recorded in Book <br />174, Page 261 as Document No. 99354. <br /> <br />4. That the subject property is located in the R-IR Residential district and <br />early education centers are not permitted uses in this district. <br /> <br />5. That the subject property is occupied by a conditional use, the Cross of <br />Rope Lutheran Church. <br /> <br />6. That the adjoining property is zoned R-IR Residential. <br /> <br />7. That there are no other similar permitted conditional uses in the City but <br />there are other similar uses. <br /> <br />8. That the proposed use will not have a significant increase in traffic flow <br />to the area as access to the subject property is from County State Aid Righway <br />No. ? which is heavily travelled. <br /> <br />9. That the proposed use will not be detrimental or dangerous to persons <br />residing or working in the vicinity of the proposed use. <br /> <br />10. That the proposed use will not substantially impair the use or enjoyment of <br />surrounding property. <br /> <br />11. That the proposed use will be operated and maintained so as to be <br />harmonious and appropriate in appearance with the character of the general <br />vic inity. <br /> <br />12. That the proposed use will not be hazardous or disturbinb to existing or <br />future neighboring uses. <br /> <br />13. That the proposed use will be adequately served by essential public <br />facilities and services. <br /> <br /> <br />
