9. That the Subject Property is one of two (2) lots that have frontage on the Rhinestone Street <br />cul-de-sac bulb and is the only property with the entirety of frontage on the cul-de-sac bulb. <br />10. That Section 117-111 (d) of the Ramsey City Code establishes a front yard setback of thirty <br />(30) feet from the right-of-way of public roads for properties within the R-1 Residential <br />(MUSA) District. <br />11. That Section 117-289 of the Ramsey City Code establishes a sixteen and a half (16.5) foot <br />permanent setback from wetlands and stormwater ponds; however, the Subject Property was <br />created prior to the adoption of this standard (adopted May 10, 2016). <br />12. That the Applicant is requesting a twenty-five (25) foot setback from the right-of-way of the <br />public road due to the wetland and drainage and utility easement on the <br />Subject Property. <br />13. That the proposed front wall of the home on the Subject Property will approximately align with <br />the existing front wall of the home on the adjacent property to the northwest. <br />14. That the request is a result of a combination of the configuration of the cul-de-sac bulb and the <br />prominence of wetlands and associated drainage and utility easements on the Subject Property, <br />which effectively prohibit the Applicant from constructing the desired building footprint while <br />meeting the setback requirements. <br />15. That in 2005, a Variance was approved by the Board of Adjustment granting a twenty-five (25) <br />foot front yard setback the Subject Property and others within the Sweetbay Ridge plat; <br />however, the documents were not recorded against the lots and thus are considered to be null <br />and void. <br />16. That the plight is not due to circumstances unique to the Subject Property. <br />17. That the plight was not created by the Applicant. <br />18. That, if granted, the Variance will not alter the locality's essential character. <br />19. That, if granted, the Variance will not impair an adequate supply of light and air to adjacent <br />property. <br />20. That, if granted, the variance will not have the effect of allowing a use that is prohibited in the <br />applicable zoning district. <br />21. That, if granted, the variance will not increase the congestion on the public street. <br />22.
