15 Ninutes CASE ~2: <br /> <br />DISCUSS ~VOCATION OF CONDITIONAL USE PERMIT <br />TO OPEItATE AUTOMOBILE SALES AND ~L~PAIR SERVICE; <br /> CASE OF MR. CEF~I.D ROOT <br />By: Anne ~orr[s, Community Development Director <br /> <br />Background: <br /> <br />As you recall, the City Council granted a conditional use permit to Mr. Gerald <br />Root to operate an automobile sales and repair service at 14600 Nowthen Blvd. <br />NW. The conditions of this agreement included that no salvage or junk yard <br />activities would be conducted from the business, that there would be no outside <br />storage of materials other than automobiles that are for sale, and certain <br />hours of operation. In addition, the City Code requires that all parking areas <br />must be adequately graded and surfaced. <br /> <br />For your information, enclosed are the following items: <br /> <br />a) Conditional use permit agreement dated May 27, 1986 between Mr. Gerald <br /> Root and the City <br />b) Letter from City Staff to Mr. Root dated June 3, 1986 <br />c) Letter from City Staff to Mr. Root dated July 17, 1986 <br />d) Letter from City Staff to Mr. Root dated August 6, 1986 <br />e) Proposed findings of fact <br /> <br />Photos of Mr. Root's operation will be available at the meeting. <br /> <br />Observations: <br /> <br />Since this permit was approved, there have been confirmed reports that Mr. Root <br />is in violation of his conditional use permit agreement. These violations <br />include: <br /> <br />a) Outdoor storage of materials other than operable automobiles; <br />b) Hours of operation which do not comply with those on the conditional <br /> use permit agreement; <br />c) Parking area is not appropriately surfaced. <br /> <br />In addition, it appears that Mr. Root is storing vehicles and equipment for a <br />construction operation on the site. This is not a permitted use in the UMB <br />District and Mr. Root's conditional use permit does not address such storage. <br /> <br />The City Code states that "the term of a conditional use permit issued herein <br />shall be indefinite and may be revoked only upon an affirmative showing that <br />the site is not being used for the use originally authorized in the conditional <br />use permit issued and in accord with the conditions attached by the City <br />Council". <br /> <br />At its August 26, 1986 meeting, the City Council granted Mr. Root 30 days to <br />comply with the conditions of his conditional use permit agreement and City <br />Code. To date, Mr. Root has not made any noticeable effort to comply with <br />these conditions. <br /> <br /> <br />
