10 I~iuutaa CASE <br /> <br />By: <br /> <br />DISCDSS FLANNING AND ZONING COMMISSION <br /> CO~4ENTS ~A~DING PLANTS AND <br />Anne Norris, Co~nity Develol~ent Director <br /> <br />Background: <br /> <br />At their August 5, 1986 meeting, the Planning and Zoning Commission noted the <br />City Council's action of July 22, 1986 regarding Plants and Things. The <br />Planning and Zoning Commission expressed concerns that the Council may be <br />allowing a variance where no hardship exists. <br /> <br />The Commission recommended that Mr. Larry Hickman be required to fullfill the <br />certified site plan as they originally requested. The Commission also noted <br />that if the Council determines to grant a variance to that requirement for Mr. <br />Hickman, the Council should specify its reasons for doing so. The Commission <br />stated that they requested the certified site plan for the following reasons: <br />1) a requirement for a building permit; and 2) the lot dimensions and lot size <br />will determine how much parking and loading area is needed. <br /> <br />The Commission also noted that Council should know that Commissioner Ben Deemer <br />was not acting independently, but rather as a member of the Planning and Zoning <br />Commission and that he was carrying out his duty as a member of that <br />Commission. <br /> <br />For your information, enclosed are the following items: <br /> <br /> a) Memo from City Attorney Goodrich dated June 3, 1986 <br /> b) Minutes of the August 5, 1986 Planning and Zoning Commission meeting <br /> c) Letter from Mr. Larry Bickman regarding plans for Plants and Things <br /> <br />Observations: <br /> <br />At its August 26, 1986 meeting, the City Council tabled action on this item <br />until a representative from the Planning and Zoning Commission could be <br />present. Several members of the Planning and Zoning Commission will be <br />attending the September 23, 1986 meeting to discuss this item with you. In <br />addition, since the August meeting, I received a letter from Mr. Bickman <br />regarding his plans for bringing Plants and Things into compliance with the <br />City Code as requested by the Planning and Zoning Commission. <br /> <br />Recomnendation: <br /> <br />Council action will be based on your discussion. <br /> <br />Review Checklist: <br /> <br />Administrator <br />Attorney <br />Engineer <br />Community Development Director <br /> <br />X <br /> <br />Chief of Police <br />Finance Officer <br />Public Works Superintendent <br />Planning and Zoning Commission <br /> <br /> <br />
