Council meeting in September, at which time a determination will be made <br />regarding compliance with the conditional use permit agreement. <br /> <br />Further Discussion: Mr. Goodrich suggested that Mr. Root remove the <br />construction equipment from the property or have the conditional use permit <br />amended. Mr. Goodrich also noted that Mr. Root will not receive any further <br />notices from the City and he should definitely plan on attending the September <br />23 Council meeting at which time Council may or may not revoke his permit. <br />Councilmember Cox suggested that Mr. Root also check city ordinances before <br />installing his fencing. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, Cox and <br />Schlueter. Voting No: None. <br /> <br />~ R~quesst For Financial Consideration Of Work Completed; Case <br /> Of Mr. Paul Johnson: <br /> <br />Mr. Raatikka stated that Mr. Paul Johnson constructed and redirected a drainage <br />ditch through his property at 16520 Germanium Street NW. The work was done <br />according to City specifications but the City did not require this work to be <br />done. Mr. Johnson is requesting financial consideration for his work. The <br />City has expended some funds for engineering and will incur more costs for <br />surveying the new ditch easement and vacating the old drainage ditch easement. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Sorteberg to deny Mr. <br />Johnson's request for financial consideration for realigning the drainage ditch <br />based on the fact that the new drainage only benefits Mr. Johnson and not the <br />City; further, to direct City Staff to prepare legal descriptions for obtaining <br />the new easement and vacating the old easement. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, Cox and <br />Schlueter. Voting No: None. <br /> <br />Request For Metes And Bounds Subdivision; Case Of Mr. Bruce <br /> <br />Ms. Norris stated that Mr. Bacon could not be present but he is requesting a <br />metes and bounds subdivision to split off 10 acres from a 22 acre parcel <br />adjacent to his property to be comined with his own lot; Mr. Bacon's neighbor <br />intends to purchase the remaining 12 acres to combine with her lot. The <br />subject 22 acre parcel is the result of a 1985 metes and bounds subdivision <br />from a 40 acre parcel owned by Mr. and Mrs. John Brolsma; the subdivision was <br />granted in accordance with Ordinances in effect at that time which did not <br />allow for a building permit to be issued on that property. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Schlueter to approve <br />Mr. Bacon's request for a metes and bounds subdivision. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmember6 Sorteberg, Cox and <br />Schlueter.
