PROPOSED FINDINGS OF FACT <br />BERNDT DEVELOPHENT CO., 1NC. <br /> <br />1. That Mr. Tom Berndt of Berndt Development Co., Inc. hereinafter referred to <br />as "Applicant," has properly applied for a conditional use permit to move in a <br />residential garage to be used for commercial purposes to the B-1 Business <br />district. <br /> <br />2. That the Applicant appeared before the Planning and Zoning Commission for a <br />public hearing pursuant to Section 170.013D of the City Code on October 7, 1986 <br />and said public hearing was properly advertised and minutes of that public <br />hearing area hereby incorporated by reference. <br /> <br />3. That the property which is the subject of the application is located at <br />6159 Highway 10 I~.W. and is legally described as follows: <br /> <br />Lot 19, Auditor's Subdivision $96, Anoka County, Minnesota, except that <br />part described as follows, to wit: Commencing at the Northwest corner of <br />said Lot 19, then Southeasterly on the Northerly line of Lot 19 a distance <br />of 125 feet; thence Southerly and parallel with the Westerly line of Lot <br />19 to the South line of Lot 19; thence West on the South line of said Lot <br />19 a distance of 125 feet more or less to the Southwest corner of said Lot <br />19, thence Northerly on the Westerly line of said Lot 19, 285 feet more or <br />less to the place of commencement, according to the map or plat thereof on <br />file and of record in the office of the Registrar of Titles in and for <br />Anoka County, State of Minnesota. <br /> <br />-and- <br /> <br />Lot 17, Auditor's Subdivision $96, exce'pt the Westerly 125 feet thereof, <br />according to the map or plat thereof on file and of record in the office <br />of the Registrar of Deeds, Anoka County, State of Minnesota. <br /> <br />4. That the subject property is located in the B-1 Business district and only <br />business uses and structures are permitted. <br /> <br />5. That there is au existing residential structure and garage located on the <br />subject property which is currently being used for commercial purposes, namely <br />an automobile sales operation. <br /> <br />6. That the Applicant is proposing to move an existing residential garage on <br />to the subject property to be used for the automobile sales operation on that <br />property. <br /> <br />7. That the Applicant is proposing to remove the existing garage from the <br />subject property. <br /> <br />8. That the garage is approximately 14' x 22'. <br /> <br />9. That the adjoining properties are zoned B-1 Business. <br /> <br />10. That there are no other similar permitted conditional uses in the area. <br /> <br /> <br />
