PROPOSED FIIiDINGS OF FACT <br />DALE WIRZ <br /> <br />1. That Mr. Dale Wirz, hereinafter referred to as "Applicant," has properly <br />applied for a conditional use permit to operate a nursery and retail business <br />in the R-iR Residential district. <br /> <br />2. That the Applicant appeared before the Planning and Zoning Commission for a <br />public hearing pursuant to Section 170.013D of the City Code on October 7, 1986 <br />and said public hearing was properly advertised and minutes of that public <br />hearing area hereby incorporated by reference. <br /> <br />3. That the property which is the subject of the application is located east <br />of State Nighway ~47 and north of Brookview Estates and is legally described as <br />follows: <br /> <br />That part of the Northwest Quarter of the Northeaster Quarter of Section <br />11, Township 32, Range 25, Anoka County, Minnesota, described as follows: <br />Commencing at the interseciton of the South line of said Northwest Quarter <br />of the Northeast Quarter with the centerline of State Highway No. 47 as <br />now laid out and constructed; thence East along said South line a distance <br />of 733 feet; then North at a right angle to a point 966 feet South of the <br />North line of said Northwest Quarter of the Northeast Quarter; then West <br />parallel with said South line to the intersection with the centerline of <br />State Trunk Highway No. 47; then Southerly along said centerline to the <br />actual point of commencement. <br /> <br />-and- <br /> <br />The South 360 feet of all that part of the North Half of the Northeast <br />Quarter of Section 11, Township 32, Range 25, Anoka County, Minnesota, <br />lying East of the center line of State Highway No. 47 (Except #25, #35, <br />945, ~55, 465, and ~75). <br /> <br />-and- <br /> <br />The South 360 feet of the East 11I feet, as measured at right angles,k of <br />the Northeast Quarter of the Northeast Quarter of Section 1I, Township 32, <br />Range 25, Anoka County, Minnesota, lying South of the North 611 feet, as <br />measured along the East line thereof. <br /> <br />4. That the subject property is located in the R-IR Residential district and <br />permitted uses include single family residential structures and agricultural <br />uses. <br /> <br />5. That agricultural uses are defined to include tree, shrub and flower <br />nurseries; however, retail sales are not permitted uses in the R-1R Residential <br />district · <br /> <br />6. That the Applicant is proposing to operate a nursery and retail business <br />from the subject property. <br /> <br />7. That the Applicant has stated that the majority of his business would be <br />wholesale business. <br /> <br /> <br />
