CASE #4: <br /> <br />DISCUSSION REGARDING FENCING REQUIREMENTS FOR PONDING AREAS <br /> By: Anne Norris, Community Development Director <br /> <br />Background: <br /> <br />As you know, Section 170.015G of the City Code requires that "every private <br />in-ground swimming pool, commercial fishing pond and other man made storm <br />water retention basins shall be enclosed by a fence or wall not less than <br />4' high to prevent uncontrolled access by small children". The City <br />Attorney has commented that this requirement may not be specific enough and <br />may, in fact, be creating the City a greater liability than we would have <br />by not requiring such fencing of ponding areas. <br /> <br />The City Attorney has requested that the Planning Commission review this <br />requirement and determine whether there should be clearer requirements <br />(i.e., depth of standing water, slopes of sides of pond) for required <br />fencing around ponding areas. <br /> <br />Enclosed for your information is Section 170.015G of the City Code. <br /> <br />Recommendations: <br /> <br />Commission Action: <br /> <br />Will be based on your discussion. <br /> <br />Review Checklist: <br /> <br />Administrator <br />Attorney <br />Engineer <br />Community Development Director <br /> <br />Chief of Police <br />Finance Officer <br />Public Works Superintendent <br />Other <br /> <br /> <br />
