PROPOSED FINDINGS OF FACT 01 <br />LAWRENCE AND SItERRIE THOLE <br /> <br />1. That Lawrence and Sherrie Thole, hereinafter referred to as <br />"Applicants", have properly applied for a Board of Adjustment <br />variances to construct an accessory structure in the front yard <br />in front of their house at 17440 Gibbon Street N.W. <br /> <br />2. That the Applicants appeared before the Board of Adjustment <br />for a public hearing pursuant Section 170.013G of the City Code <br />on October 30, 1986 and that said public hearing was properly <br />advertised and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br /> <br />3. That the subject property is generally known as 17440 Gibbon <br />Street N.W. and is legally described as follows: <br /> <br />Lot 3, Block 1, Deerwood, Anoka County, Minnesota. <br /> <br />4. That the subject property is located in the R1-R Residential <br />District and is approximately 3.3 acres in size. <br /> <br />5. The Applicants are requesting a variance to construct a <br />30' x 40' accessory structure in the front yard of their <br />property. <br /> <br />6. That Section 170.015G of City Code requires all detached <br />accessory structures to be located in the side or rear yard. <br /> <br />7. That the Applicants are proposing to construct the accessory <br />structure in front of the existing house on their property. <br /> <br />8. That Section 170.015G of City Code states that no accessory <br />structures shall be located nearer the front lot line than the <br />principal building on that lot. <br /> <br />9. That the Applicants have stated that they are proposing to <br />construct an accessory structure in the front yard in front of <br />their house due to wetland areas on their property. <br /> <br />10. That the Applicants have stated that their unique <br />conditions, namely the wetland areas, do not apply generally to <br />other properties in the district. <br /> <br />11. That the Applicants have stated that such variance is <br />necessary for the preservation and enjoyment of the property <br />rights similar to that possessed by other properties in the same <br />vicinity. <br /> <br />12. That the Applicants have stated that the unique condition is <br />not a result of their actions. <br /> <br />13. That if the variance is granted to the Applicants, they will <br /> <br /> <br />
