FINDINGS OF FACT ~01 <br /> GARY AND CItERI RICE <br /> <br />I. That Gary and Cheri Rice, hereinafter referred to as tbs "Applicants,*' have <br />property applied for a conditional use permit to operate a tuxedo rental <br />business from their home at 15210 Waco Street N.W. <br /> <br />2. That the Applicants appeared before the Planning and Zoning Commission for <br />a public hearing pursuant to Section 170.016 of the City Code on July 8, 1986 <br />and said public hearing was properly advertised and minutes of that public <br />hearing are hereby incorporated by reference. <br /> <br />3. That the property which is the subject of the spplication is locsted at <br />15210 Waco Street N.W. and is legally described as follows: <br /> <br />The West 217.8 feet of the East 435.6 feet of the South 200 feet of the <br />North 633 feet of the West Half of the Southeast Quarter of Section 24, <br />Township 32, Range 25, Anoka County, Minnesota as measured along the North <br />and East line of said West Half of Southeast Quarter (subject to an <br />easement for road purposes over the East 33 feet thereof). <br /> <br />4. That the subject parcel is approximately 1 acre in size and is located in <br /> the UER Urban Existing Residential district. <br /> <br />5. That the property is zoned UER Urban Existing Residential and a tuxedo <br />rental business is not a permitted use in this district. <br /> <br />6. That the adjoining properties are zoned UER-Urban Existing Residential. <br /> <br />7. That there are no other similar permitted uses in the UER Urban Existing <br />Residential district. <br /> <br />8. That there would not be a significant increase in traffic flow to the area. <br /> <br />9. That the proposed use will not be detrimental to persons living in that <br />area or to the general public and it will not impair the enjoyment of other <br />properties in the area. <br /> <br />10. That the Criteria for Approval/Disapproval are as follows: <br /> <br />That the Applicants' request to operate a tuxedo rental business from <br />their home will not be detrimental to the health, safety or general <br />welfare of the public; <br /> <br />b. That the proposed use will not be unsightly or obnoxious; <br /> <br />c. That the proposed use will not hinder the orderly development of the <br /> UER Urban Existing Residential district; <br /> <br />d. That the proposed use will not restrict the enjoyment of the other <br /> property in the vicinity; and <br /> <br />e.
