FINDINGS OF FACT d01, SCOTT SPRINGER <br /> <br />I. That Scott Springer, hereinafter referred to as ~lpplicsnt," has properly <br />applied for a conditional use permit to operate a sno~ plowing operation fro~ <br />hi~ home at 8872 175th Lane N.W. <br /> <br />2. That the Applicant appeared before the Planning and Zoning Commission for s <br />public hearing pursuant to Section 170.016 of the City Code on July 8, 1986 and <br />said public hearing was properly advertised and minutes of that public hearing <br />are hereby incorporation by reference. <br /> <br />3. That the property which is the subject of the application is located at <br />8872 175th Lane N.W. and is legally described as follows: <br /> <br /> Lot 2, Block 10, Countryside Estates, Anoka County, Minnesota (subject to <br /> easements on the plat). <br /> <br />4. That the subject parcel is approximately 1 acre in size and is located in <br /> the R-1 Residential district. <br /> <br />5. That the property is zoned R-1 Residential and a snow plowing operation is <br /> not a permitted use in this district. <br /> <br />6. That the adjoining properties are zoned R-1 Residential. <br /> <br /> 7. That there are no other similar permitted uses in the R-1 Residential <br /> district. <br /> <br />8. That there would not be a significant increase im traffic flow to the area. <br /> <br /> 9. That the proposed use may be detrimental to persons living in that area or <br /> to the general public and it may impair the enjoyment of other properties in <br /> the area. <br /> <br /> 10. That the Criteria for Approval/Disapproval are as follows: <br /> <br /> a. That the Applicant's request to operate a snow plowing business from <br /> his home will not be detrimental to the health, safety or general <br /> welfare of the public; <br /> <br /> b. That the proposed use may be unsightly or obnoxious in appearance; <br /> <br /> c. That the proposed use may hinder the orderly development of the R-1 <br /> Residential district; <br /> <br /> d. That the proposed use may restrict the enjoyment of other properties in <br /> the vicinity; and <br /> <br /> e. That the proposed use will conform to all other applicable restrictions <br /> of the R-1 Residential district. <br /> <br /> <br />
