170.01 .~H IION-CONFORIqIIIG USES <br /> <br />INTENT~ It is the intent of this chapter to permit an existing <br />non-conforming use to contibue until it is removed, but not to <br />encourage its use or ~xpansion. <br /> <br />Any structure and/or use existing upon the effective date of the <br />adoption of this chapter may be continued as long as it remains <br />otherwise lawful provided that it meets the follovin~ provisions. <br /> <br />No such use and/or structure shall be expanded or <br />enlarged except in conformity with the provisions of <br />this chapter. <br /> <br />A non-conforming use of a structure which has been <br />discontinued for a period of twelve (12) months shall <br />not be re-established and any further use shall be in <br />conformity with the regulations of this chapter. <br /> <br />A non-conforming structure which is damaged by any cause <br />to the extent of more than fifty percent (501) of its <br />market value aa determined by the current records of the <br />City Assessor shall not be restored except in conformity <br />with the regulations of this chapter. <br /> <br />Normal maintenance of a non-conforming use and/or <br />structure is permitted. ~iaintenance may include <br />necessary non-structural repairs and incidental <br />alterations which do not enlarge or intensify the non- <br />conforming use. <br /> <br />Buildings meeting City standards on setbacks as listed <br />in Section 170.016 shall in no case be considered non- <br />conforming for the setbacks. <br /> <br />l~hen any lawful non-conforming use has been changed to a <br />conforming use, it shall not thereafter be changed to <br />any unlawful non-conforming use. <br /> <br />The City Administrator shall conduct an inspection on a <br />periodic basis of all non-conforming uses and report the <br />findings to the Planning and Zoning Commission and the <br />City Council within sixty (60) days of his inspection <br />for their information. <br /> <br /> <br />
