CONSIDERATION OF PURCHASE OF 160TM LANE <br /> THROUGH THE KAAS/DUSBABEK PROPERTIES <br />By: Patrick Trudgcon, AICP, Assistant Community Development Director <br /> <br />CASE #: 5 <br /> <br />Background: <br /> <br />On December 12, 2003, the Ramsey City Council approved the final plat of Trappers Ridge, a two-lot plat <br />submitted by Greg Bauer. At the time of the plat approval, the City granted permission for Mr. Bauer to <br />construct a private driveway in what was believed to be the public right-of-way of 160th Lane NW. 160th <br />Lane NW was not constructed all the way to Mr. Bauer's property. City Staff allowed for Mr. Bauer to <br />remove trees for the driveway in January in preparation for construction of a house on the new lot. After the <br />removal of trees, Staff' received a phone call fi:om Mr. Steve Dusbabek, an adjacent property owner to the <br />no~h of the presumed right-of-way. Mr. Dusbabek informed City Staff'that he still owned the area <br />presumed to be the 160~' Lane right-of-way as well as his neighbors to the south, Fran and Lori Kaas. In <br />researching the matter, Staff and the City Attorney discovered that when the land to the east of Bauer <br />property was subdivided in 1964, 160~h Lane was not dedicated as a public road. In fact, after doing title <br />research, the City Attorney found that although an easement for road purpose was created, there was no <br />indication that the easement was dedicated to the City. <br /> <br />At the March 30, 2004 Work Session, the Council directed staffto order an appraisal on the effect of tree <br />removal to the value of the Dusbabek and Kaas property as well as an appraisal of the cost to purchase the <br />road easement outright. Staff did, however, send indivdual notice to the adjacent property <br />owners, the Dusbabek and Kaas families. <br /> <br />Observations: <br /> <br />Below is a table listing the value that the appraisals showed for both properties if the City were to <br />pay for the value of the trees removed or if the City would purchase the road easement outright. <br /> <br /> <br />
