Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #04-07- A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO RAMDANCE LLC TO CONSTRUCT A COMMERCIAL CAR WASH IN THE TC-2 ZONING DISTRICT AND DECLARING TERMS OF SAME: WHEREAS, Ramdance LLC, hereinafter referred to as the "Applicant," has proper[}, applied for a Conditional Use Permit to construct a commercial car wash in the TC-2 Zoning District on property legally described as follows: Outlot l, Ramsey Town Center Addition, Anoka County, Minnesota ("Subject Property") ? WHEREAS, the Planning Commission met on July 12, 2004, conducted the public hearing and recommended City Council approval of the request. NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: Based on Findings of' Fact #__, a Conditional Use Permit (Permit) to construct a commercial car wash in the TC-2 Zoning District, is hereby granted to Ramdance, LLC, hereinafter referred to as the "Permittee". That the Permit only applies to a commercial car wash constructed as an accessorY use to the proposed grocery store that will be located. in the futm'e Lot 1, BloCk 1 of Ramsey Town Center 3rd Addition. 3. That thc Permit only allows for a 1,777 square-foot commercial car wash to be constructed, That the commercial car wash shall only be located as shown on the proposed site plan for the grocery store. Any relocation of the car wash shall be reviewed and approved by the City Council. That the area utilized for the car wash shall be properly constructed and maintained in accordance with all applicable Staff Review letters, approved site plans, City Code, and Unifbrm Building Codes. 6. That this Permit shall be perpetual in duration as long as the terms are herein complied with..
