Councilmembcr Elvig asked if the police will have discretion regarding enforcement and whether warnings would be issued. He also asked if there were plans to educate the public about the revised ordinance. Police Captain Dwyer stated that the Police Department will actively work to educate the public about the revised ordinance and will most likely use some discretion when enforcing the revised ordinance. Mayor Gamec inquired about the issue of noise created by bands playing after 11:00 p.m. and how that issue will be addressed. In particular, Mayor Gamec stated the City receives noise complaints Ii'om residents during City-sponsored events. City Attorney Goodrich stated that the issue of noise created by bands would be enforced as currently stated in the ordinance. He stated that the ordinance could be amended to include permitted uses, e.g., bands that have a permit, and the perrnit could include a specific time limit, such as 11:00 p.m. during City-sponsored events. City Attorney Goodrich stated that hc would draft language for review by the City Council at its July 27, 2004 meeting that specifically addresses the time limits related to noise during City- sponsored events. Consensus of the City Council was to direct staff to draft language for incorporation into the proposed Public Nttisance Ordinance which specifically addresses the time limits related to noise during City-sponsored events. The Public Nuisance Ordinance will then be reviewed in its entirety at the July 27, 2004 meeting of the City Council with opportunity for public comment at that time. 2) 'RTC - Develol)mcnt Agreement Amendments City Administrator Norman reported that staffwas previously directed to'continue work on this, and a meeting is scheduled with the developer this week. He indicated the City Council is not expected to take action and staff is seeking direction at this time. Finance Officer Lund distributed a fiscal impact study outlining projected city tax rates. She stated that currently it is anticipated there will be no debt incurred in 2005 for the City Hall and Town Center. She also stated the tax capacity rate represents a very conservative number. City Administrator Norlllan advised that grant monies will be available; however, these numbers are not included in the fiscal impact study. He indicated the remaining issues deal with assessments and escrow and AUAR. City Administrator Norman stated that two small issues remain with respect to thc agent position and letter of credit. He stated that if the City Councihnembers have questions, they are encouraged to contact him or Finance Officer Lund. Councihnember Cook inquired about a Special Tax District and whether the City wanted to have more monies available now via special/tax assessments in order to do improvements.
