CASE ~1: <br /> <br />REQUEST FOR VARIANCE FROM SIDE YARD SETBACK REQUIREMENTS; <br /> CASE OF MR. CLARENCE JENSEN FOR NORTHERN OXYGEN <br /> By: Anne Norris, Community Development Director <br /> <br />Background: <br /> <br />Clarence Jensen, representing Northern Oxygen, is requesting a variance <br />from the side yard setback in order to construct a 50' x 100' addition to <br />the south side of the existing building at 6650 Hwy. #10 N.W. This <br />property is located in the B-1 Business District, Mr. Jensen's property is <br />a corner lot and is bounded on three sides by streets: Dolomite Street N.W. <br />is to the west; 138th Avenue N.W. is to the south; and Highway #10 N.W. is <br />to the north. The City Code requires that the side yard setback for corner <br />lots be at least 20' wide; Mr. Jensen is proposing a five foot encroachment <br />on the required side yard, leaving a 15 foot wide side yard setback. Mr. <br />Jensen's lot is approximately 1.35 acres in size. <br /> <br />The City Code specifies that variances may be granted in cases where there <br />are exceptionally unique circumstances and where a hardship exists. <br /> <br />Enclosed for your information are the following items: <br /> <br />a) Application <br />b) Site location map <br />c) Public hearing notice <br />d) Properties notified <br />e) Proposed site plan <br /> f) Letter dated November 10, 1986 from Joe Sentyrz regarding the request <br /> g) Proposed findings of fact <br /> h) Draft of variance (this has not been provided to Mr. Jenson) <br /> <br />Recommendation: <br /> <br />Board of Adjustment Action: <br /> <br />Motion to: <br />Adopt findings of fact relating to Mr. Clarence Jensen's request for <br />variance from the side yard setback requirements. <br /> <br />-and- <br /> <br />Motion to: <br />Approve/deny Mr. Clarence Jensen's request for a variance from the side <br />yard setback in order to construct an addition to the building at 6650 <br />Hwy. #10 N.W. <br /> <br />Review Checklist: <br /> <br />Administrator <br />Attorney <br />Engineer <br />Community Develepment Director X <br /> <br />Chief of Police <br />Finance Officer <br />Public Works Superintendent <br />Other <br /> <br /> <br />
