PROPOSED FINDINGS OF FACT <br />CLAREMCE 2ENSEN/NORTHERN OXYGEN <br /> <br />1. That Clarence Jensen, hereinafter referred to as "Applicant", has properly <br />applied for a Board of Adjustment variance from the side yard setback <br />requirements in order to construct an addition to the existing building at 6650 <br />Hwy. ~]0 N.W. <br /> <br />9. That the Applicant ~ppeared before the Board of Adjustment for a public <br />hearing pursuant to Section 170.013G of the City Code on November 20, I986 and <br />that said public hearing was properly advertised and the minutes of said public <br />hearing are hereby incorporated as a part of these findings of fact by <br />reference. <br /> <br />3. That the subject property is generally known as 6650 Hwy. ~10 N.W. and is <br />legally described as follows: <br /> <br />Lot l, Block 2, Riverside West, Anoka County, Minnesota <br /> <br />4. That the subject property is located in the B-1 Business District and is <br />approximately 1.35 acres in size. <br /> <br />5. That the subject property is a corner lot and is bounded on the west by <br />Dolomite Street N.W., bounded on the south by 138th Avenue N.W. and bounded on <br />the north by Hwy. #10 N.W. <br /> <br />6. That the applicant is requesting a variance from the side yard setbacks in <br />order to construct a 50' x 100' addition south of the existing building. <br /> <br />7. That the proposed addition will encroach on side yard setback by 5'; there <br />will be side yard setback of 15'. <br /> <br />8. That Section 170.016G of the City Code requires the side yard setback <br />on a corner lot to be a minimum of 20'. <br /> <br />9. That the Applicant has stated that the unique condition, namely a corner <br />lot bounded by three streets, does not apply generally to other properties in <br />the B-1 Business District. <br /> <br />10. That the Applicant has stated that such variance is necessary for the <br />preservation and enjoyment of the property rights similar to that possessed by <br />other properties in the same vicinity. <br /> <br />11. That the Applicant has stated that the unique condition, frontage on three <br />roads, is not a direct result of his action. <br /> <br />12. That if the variance is granted, the applicant will not receive any <br />special privilege that is denied by the City Code to other owners of lands, <br />structures or buildings in the B-1 Business District. <br /> <br />13. That the Applicant is requesting a minimum variance, namely a 5' <br />encroachment on the required side yard setback, to alleviate the hardship. <br /> <br /> <br />
