engaged a legal firm to sue the State of Minnesota; 5 real estate firms have <br />viewed his property and render it unsaleable. <br /> <br />Oouncilmember Cox noted that with the time frame imposed by the City Charter, <br />we will be into the rainy season before we can begin to r~{nedy the problem. <br />Normally, the City would have been able to move in a much more effective <br />manne r. <br /> <br />Mayor Heitman stated that prior to the City Charter, Council may have been <br />able to move in a different manner but not necessarily a more effective <br />manner. <br /> <br />City Attorney Goodrich advised Mr. Battenberg to have his attorney contact him <br />to work out just what kind of written support Mr. Battenberg is looking for <br />f rom the City. <br /> <br />Councilmember Schlueter suggested that a representative of DNR be invited to <br />attend the public hearing. <br /> <br />Mr. Schnelle stated that a representative from DNR cannot change anything; it <br />is going to require Council getting involved at the County and State level. <br /> <br />Councilmember Cox stated that he will be meeting with persons from DNR in the <br />near future and will discuss this issue with them. <br /> <br />Motion by Counci]3nember Cox and seconded by Councilmember Schlueter to <br />authorize City Staff to contact legislators regarding this wetland issue and <br />request that legislators direct DNR to address wetland situations on a case by <br />case basis and amend their regulations. <br /> <br />Motion carried. Voting Yes: Mayor Beitman, Councilmembers Sorteberg, Cox, <br />Reimann and Schlueter. Voting No: None. <br /> <br />Council unanimously consented to dispense with the reading of the resolution. <br /> <br />Motion by Councilmember Schlueter and seconded by Mayor Beitman to adopt <br />Resolution #85-8 receiving the feasibility report for the Battenberg drainage <br />problem. (Please refer to resolution file for Resolution {85-8). <br /> <br />Motion carried. Voting Yes: Mayor Heitman, Councilmembers Sorteberg, COx, <br />Reimann and Schlueter. Voting NO: None. <br /> <br />c) <br /> <br />Receiving Feasibility Report And Setting A Public Bearing For ~he <br />Extension Of Municipal Utilities To ~he Plat of River's Bend Second <br />Addition - <br /> <br />Council unanimously consented to dispense with the reading of the resolution. <br /> <br />Motion by Councilmember Schlueter and seconded by Councilmember COx to adopt <br />Resolution #85-9 identifying the affected property owners for River's Bend <br />Second Addition. (Please refer to resolution file for Resolution #85-9). <br /> <br />Motion carried.
